SHIPPING POLICY

1. SHIPPING DESTINATIONS

Ben Textiles Inc. currently ships to locations within the United States and Canada.

International orders outside of Canada may be accepted at Seller's sole discretion and may be subject to additional shipping, customs, brokerage, regulatory, and documentation requirements.

1. SHIPPING METHODS

Ben Textiles Inc. utilizes various carriers, including but not limited to:

• United Parcel Service (UPS)
• United States Postal Service (USPS)
• Less-Than-Truckload (LTL) Freight Carriers
• Regional Freight Carriers
• Other Shipping Providers Selected by Seller

Available shipping methods may include:

• UPS Ground
• UPS 3 Day Select
• UPS 2nd Day Air
• UPS Next Day Air
• USPS Services
• LTL Freight Services

Seller reserves the right to select, substitute, or change the shipping carrier or service level without prior notice when deemed necessary for operational, logistical, or cost considerations.

1. PROCESSING TIMES

Orders are processed Monday through Friday, excluding holidays.

Most orders are processed and shipped within approximately five (5) business days.

During peak business periods, including but not limited to March through November, processing times may extend to ten (10) business days or longer.

Processing times are estimates only and are not guaranteed.

Seller shall not be liable for delays caused by inventory shortages, weather conditions, carrier delays, customs inspections, labor disruptions, force majeure events, or other circumstances beyond Seller's control.

1. FREE SHIPPING PROGRAM

Orders exceeding Fifty Dollars ($50.00 USD) may qualify for free standard ground shipping within the contiguous United States.

Free shipping is not available for:

• Alaska
• Hawaii
• Puerto Rico
• U.S. Territories
• Canada
• International destinations
• Oversized shipments
• Freight shipments
• Special-order products

Seller reserves the right to modify, suspend, or discontinue free shipping promotions at any time without notice.

1. HANDLING FEES

All orders are subject to a handling fee of Three Dollars and Ninety-Nine Cents ($3.99).

Handling fees are non-refundable.

1. SHIPPING INSURANCE

Unless otherwise specified by Seller, UPS shipments include carrier-provided coverage of up to One Hundred Dollars ($100.00 USD) per package or tracking number.

Additional shipping insurance may be available for purchase upon request.

Unless mandatory for a specific product, shipping insurance is optional and must be requested by Buyer prior to shipment.

Seller shall not be responsible for losses exceeding carrier-provided coverage unless additional insurance has been purchased and paid for by Buyer.

1. CUSTOMS, DUTIES, TAXES, AND IMPORT FEES

For all Canadian and international shipments, Buyer is solely responsible for:

• Customs duties
• Brokerage fees
• Import taxes
• Value-added taxes (VAT)
• Government fees
• Customs examinations
• Regulatory charges
• Any other import-related costs

Refusal of delivery due to unpaid duties, taxes, customs charges, or brokerage fees shall not entitle Buyer to a refund.

1. SAMPLES

Samples may be shipped using USPS, UPS, or other carriers selected solely by Seller.

Seller shall determine the shipping method for sample orders without prior consultation with Buyer.

Delivery times for samples are estimates only and are not guaranteed.

1. TITLE AND RISK OF LOSS

ALL SALES ARE FOB ORIGIN.

Title to and risk of loss for all goods pass to Buyer immediately upon Seller's delivery of the goods to the carrier.

Once goods are transferred to the carrier:

• Buyer becomes the legal owner of the goods.
• Buyer assumes all risk of loss or damage.
• Buyer is responsible for filing any freight claims.
• Seller has no liability for carrier delays, loss, theft, damage, or misdelivery.

1. FREE SHIPPING ORDERS

For orders qualifying for free shipping:

FOB Origin, Freight Allowed

• Seller pays shipping charges.
• Buyer owns goods while in transit.
• Buyer bears risk of loss.
• Buyer files freight claims directly with the carrier.

Although Seller pays shipping costs, title and risk of loss transfer to Buyer when goods are delivered to the carrier.

1. NON-FREE SHIPPING ORDERS

For orders that do not qualify for free shipping:

FOB Origin, Prepaid and Added

• Seller arranges shipment.
• Shipping charges are billed to Buyer.
• Buyer owns goods while in transit.
• Buyer bears risk of loss.
• Buyer files freight claims directly with the carrier.

Title and risk of loss transfer to Buyer immediately upon delivery of goods to the carrier.

1. DELIVERY ESTIMATES

Any quoted shipping or delivery date is an estimate only.

Seller does not guarantee delivery dates, transit times, arrival dates, or carrier performance.

Seller shall not be liable for any losses, damages, expenses, business interruptions, labor costs, missed deadlines, or consequential damages arising from delayed deliveries.

1. ADDRESS ACCURACY

Buyer is solely responsible for providing accurate shipping information.

Additional charges incurred due to:

• Incorrect addresses
• Returned shipments
• Refused deliveries
• Address corrections
• Reconsignment requests

shall be the responsibility of Buyer.

1. LOST OR DAMAGED SHIPMENTS

Any shipment loss, shortage, visible damage, concealed damage, or delivery discrepancy must be reported directly to the carrier immediately.

Buyer agrees to cooperate fully in any freight claim investigation.

Seller may assist with documentation but assumes no obligation to prosecute claims on Buyer's behalf.

1. FORCE MAJEURE

Seller shall not be liable for delays or failures in shipment caused by events beyond Seller's reasonable control, including but not limited to:

• Natural disasters
• Floods
• Earthquakes
• Fires
• Labor disputes
• Transportation interruptions
• Government actions
• Customs delays
• Material shortages
• Carrier failures
• Pandemics
• Cybersecurity incidents

1. MODIFICATIONS

Ben Textiles Inc. reserves the right to modify this Shipping Policy at any time without prior notice.

1. GOVERNING LAW

This Shipping Policy shall be governed exclusively by the laws of the State of California.

Any dispute arising from this Shipping Policy shall be brought exclusively in the state or federal courts located in Los Angeles County, California.
